Delta Air Lines is facing a lawsuit filed by aviation attorney Mark Lindquist on behalf of a passenger who sustained severe burns from boiling coffee spilled during a flight. The incident occurred on December 15, 2023, when the victim was flying from Paris to Seattle. A Delta flight attendant placed an extremely hot cup of coffee on a slanted tray, causing it to slide and spill onto the victim’s lap.

The passenger, a flight attendant for another airline, immediately reported her injuries to Delta’s crew, but they allegedly dismissed her concerns, suggesting she “just go change.” After multiple pleas for assistance and showing the severity of her burns to a flight attendant, she was provided only a pain reliever and a bandage. Delta’s crew declined to make an in-flight announcement for medical help or contact a remote medical provider for guidance, as is typically standard.

When the flight landed at SeaTac Airport, paramedics were shocked by the extent of the burns, stating they were the worst they’d seen from coffee. The victim suffered blistering burns on her hip, side, and abdomen, leaving her unable to perform daily tasks for months, including showering, driving, and wearing regular clothes. Pain management required opiates, which further impacted her ability to function.

The lawsuit accuses Delta of violating the Montreal Convention and negligence, claiming the airline served coffee at a temperature above industry standards and failed to provide timely medical care, which worsened the victim’s injuries. Although she has returned to work as a flight attendant, the burns have left her with permanent scars.
